Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Gather ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

2. Description of Service

Gather is an event planning app that allows you to:

• Create and manage events with multiple functions (sub-events)
• Manage guest lists and send invitations
• Track RSVPs and attendance
• Purchase and manage event tickets
• Track event budgets and expenses
• Discover public events

3. Eligibility

You must be at least 13 years old to use Gather. By using the app, you represent that you meet this age requirement.

4. Account Registration

• You may sign in using Apple Sign-In, Google Sign-In, or email authentication.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account.

5. User Conduct

When using Gather, you agree not to:

• Use the app for any unlawful purpose
• Upload or share offensive, harmful, or inappropriate content
• Impersonate any person or entity
• Spam or send unsolicited invitations to people who have not consented
• Attempt to gain unauthorized access to other users' data
• Interfere with or disrupt the app's functionality
• Use the app to collect personal information of others without their consent
• Violate any applicable laws or regulations

6. Event Hosting

As an event host, you:

• Are solely responsible for the accuracy of your event information
• Are responsible for managing your guest list and invitations appropriately
• Must comply with all applicable laws for hosting events (permits, capacity limits, etc.)
• Understand that making an event public means it can be discovered by other Gather users

7. Ticketing

For Event Hosts

• You are responsible for setting accurate ticket prices, capacities, and descriptions
• You must honor all tickets sold through the app
• Refund policies must comply with applicable consumer protection laws
• Promo codes and discounts are your responsibility to manage

For Ticket Purchasers

• All ticket purchases are subject to the event host's terms and conditions
• Ticket availability is not guaranteed until purchase is confirmed
• Refund eligibility depends on the event host's refund policy
• Tickets are non-transferable unless specified by the event host

8. Intellectual Property

• Gather and all its content, features, and functionality are owned by thebighead and are protected by copyright and other intellectual property laws.
• You retain ownership of any content you create within the app (event descriptions, guest lists, etc.).
• By using the app, you grant us a limited license to use your content solely for the purpose of providing the service.

9. Privacy

Your use of Gather is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

10. Disclaimers

• Gather is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• We do not guarantee that the app will be uninterrupted, error-free, or secure.
• We are not responsible for the accuracy of event information posted by other users.
• We are not responsible for any disputes between event hosts and guests.
• We are not liable for any events, their organization, safety, or outcomes.

11. Limitation of Liability

To the maximum extent permitted by law, thebighead shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app, including but not limited to:

• Loss of data or content
• Event cancellations or changes
• Payment disputes
• Unauthorized access to your account
• Any third-party actions or content

12. Indemnification

You agree to indemnify and hold harmless thebighead from any claims, damages, losses, or expenses arising from:

• Your use of the app
• Your violation of these Terms
• Your violation of any rights of another party
• Events you host or attend through the app

13. Modifications to the Service

We reserve the right to:

• Modify or discontinue any feature of the app at any time
• Update these Terms at any time
• Limit or restrict access to the app

We will notify users of significant changes through the app or via email.

14. Termination

• You may stop using Gather at any time by deleting the app.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your right to use the app ceases immediately.
• Sections regarding intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of Gather shall first be attempted to be resolved through informal negotiation. If unresolved, disputes shall be submitted to the courts of Ontario, Canada.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and thebighead regarding your use of Gather.
