1. Agreement

These terms govern your use of Jotter ("the app"), published by The Big Head, Edmonton, Alberta, Canada. By downloading or using the app you agree to them. If you do not agree, please do not use the app.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Jotter on Apple devices you own or control, in line with the Apple Media Services Terms and Conditions. You may not copy, decompile, reverse engineer, resell or redistribute the app, or remove any proprietary notices from it.

3. Your notes are yours

You retain all rights to the notes, drawings, photos, recordings and other content you create or add in Jotter. We claim no ownership over it and, because the app has no server, we do not receive it. Responsibility for that content — including keeping it lawful and keeping your own backups — rests with you. Settings → Export all notes gives you a complete copy at any time.

5. Sync and data loss

Jotter syncs through Apple’s iCloud service. Availability of that service is outside our control. While Jotter is designed to work fully offline and to preserve your notes, you are responsible for maintaining your own backups. We are not liable for data loss arising from device failure, iCloud outages, account changes, or deletion of the app.

6. Locked notes

Locking a note hides it behind your device’s Face ID, Touch ID or passcode inside the app. It is not encryption, and it does not protect a note from anyone who can unlock your device or your iCloud account.

7. Acceptable use

Do not use Jotter to break the law, to infringe anyone’s rights, or to attempt to interfere with the app’s security or with Apple’s services.

8. No warranty

Jotter is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that text recognition and transcription will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, The Big Head is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of your use of the app. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

10. Apple

Apple is not a party to these terms and has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Termination

You may stop using Jotter at any time by deleting it. We may suspend or terminate the licence if you materially breach these terms.

12. Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
